Terms of Service

By accessing or using the services provided by TouchPlay Inc. (“TouchPlay,” “we,” “us,” or “our”), a Delaware C Corporation, including our website at touchplay.dev and all related tools, APIs, and products (the “Services”), you agree to be bound by these Terms. If you do not agree, you may not use our Services.

You must be at least 13 years of age to use TouchPlay. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

TouchPlay is an agentic playable ad creation platform that uses artificial intelligence to transform gameplay videos and creative briefs into production-ready, interactive HTML5 playable advertisements. Our Services include video ingestion, AI-driven code generation, live preview, and ad export.

You agree not to generate ads that:

• Violate any applicable law or regulation.
• Infringe upon intellectual property rights of third parties.
• Contain content rejected by the Apple App Store or Google Play Store under their respective content policies.
• Promote illegal activities, violence, hate speech, or discrimination.
• Contain malware, phishing, or deceptive functionality.
• Misrepresent the nature of the advertised product.

We reserve the right to review, refuse, or remove any content that violates these Terms.

• Maintain the confidentiality of your account credentials.
• You are responsible for all activities under your account.
• Notify us immediately of any unauthorized use.
• We reserve the right to suspend or terminate violating accounts.

Certain features require a paid subscription. Pricing and billing terms will be communicated at purchase. All fees are non-refundable unless required by law. We reserve the right to modify pricing with reasonable notice.

We strive for high availability but do not guarantee uninterrupted access. Current system status is available at status.touchplay.dev.

To the maximum extent permitted by law, TouchPlay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not warrant that generated ads will be accepted by any specific advertising network or app store.

You agree to indemnify, defend, and hold harmless TouchPlay from any claims, damages, and expenses arising out of: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) content you upload or generate.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Disputes shall be resolved exclusively in Delaware state or federal courts.

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the “Last updated” date. Continued use constitutes acceptance.

We may suspend or terminate your access at any time. Upon termination, your right to use the Services ceases immediately. Provisions regarding IP, liability, and indemnification survive termination.
